BUYER: The real or legal person whose name, surname, delivery address, and contact information are included in the order form. The information declared by the Buyer during the order is taken as a basis; the Buyer is responsible for the accuracy of this information.
2. Definitions
In this agreement; Law: Law No. 6502 on Consumer Protection, Regulation: Distance Contracts Regulation published in the Official Gazette dated 27.11.2014 and numbered 29188, Site: The website named camtablolar.com, Product: Glass wall art and similar products offered for sale on the Site, produced with UV printing technique on tempered glass, Custom Product: Products specially produced for the Buyer in line with the visual uploaded or requests made by the Buyer, Order Confirmation: Refers to the confirmation of the order by the Seller in electronic environment.
3. Subject of the Agreement
The subject of this agreement is the determination of the rights and obligations of the parties in accordance with the provisions of the Law and the Regulation regarding the sale and delivery of products ordered electronically by the Buyer through the Site, the characteristics and sales price of which are specified in the order summary and on the payment page. The Buyer accepts and declares that they have read and electronically confirmed the preliminary information regarding the basic characteristics of the product, its sales price, payment method, delivery conditions, and the right of withdrawal before placing the order.
4. Product Subject to the Agreement, Price, and Payment Information
The type, category, quantity, size, sales price, and payment method of the product are as stated in the order summary at the end of the order process and in the order confirmation email sent to the Buyer. The advertised prices are in Turkish Lira and include VAT. The Seller is bound by the advertised prices until an update is made; limited-time campaign prices are valid until the end of the specified period.
- Credit/Debit Card: Single payment or 3 interest-free installments are offered with 3D Secure infrastructure. Card information is not stored in the Seller's systems; payment is made through the infrastructure of a licensed payment institution.
- Bank Transfer/EFT: Payment is made to the bank account provided after the order. Orders for which a transfer notification is not made will be canceled at the end of 3 (three) business days.
- Cash on Delivery: If selected, any additional service fee will be shown in the order summary.
5. General Provisions
5.1. The Buyer declares that they have read and understood the preliminary information regarding the basic characteristics, sales price, payment method, and delivery of the product on the Site, and have provided the necessary electronic confirmation.
5.2. The Seller accepts and undertakes to deliver the product subject to the agreement completely, in accordance with the specifications stated in the order, and with any warranty documents, free from any defects, in a sound and standard-compliant manner according to legal regulations, and to perform the work based on principles of accuracy and honesty.
5.3. If the product subject to the agreement is to be delivered to a person other than the Buyer, the Seller cannot be held responsible if the person to be delivered does not accept the delivery.
5.4. If the delivery of the product subject to the order becomes impossible, the Seller shall notify the Buyer in writing or via a permanent data storage device within 3 (three) days from the date of learning of this situation and shall refund all payments collected, including any delivery costs, within a maximum of 14 (fourteen) days from the date of notification.
6. Delivery
6.1. Delivery is made to the address specified by the Buyer in the order form via the contracted cargo company. Products in stock are shipped within 2-4 business days following order confirmation, and custom-made products are shipped within 5-7 business days following digital proof approval. In any case, the delivery period, to the extent appropriate for the committed period as per the Regulation, cannot exceed 30 (thirty) days from the date the order reaches the Seller.
6.2. Products are packaged with special protective packaging against breakage and sent via insured shipping. If the order total exceeds the advertised free shipping threshold, the shipping cost is borne by the Seller; otherwise, the shipping cost is shown in the order summary and paid by the Buyer.
6.3. The Buyer is obliged to check the packaging upon receipt; damaged products such as dented, broken, torn packaging, etc., must not be accepted by having the cargo official prepare a damage assessment report. The received product is considered undamaged and sound. The responsibility for carefully protecting the product after delivery belongs to the Buyer.
7. Right of Withdrawal
7.1. The Buyer has the right to withdraw from the agreement without stating any reason and without paying any penalty within 14 (fourteen) days from the date of delivery of the product to themselves or to the person at the address indicated.
7.2. To exercise the right of withdrawal, it is sufficient to send a clear notification of withdrawal to the Seller via email (info@camtablolar.com), phone (0506 060 50 17), or through the account page on the Site within this period.
7.3. In case the right of withdrawal is exercised, the product, along with its invoice and all complementary parts (if possible, in its original packaging, without losing its re-saleability), must be returned to the Seller within 10 (ten) days following the notification of withdrawal. For returns made with the Seller's designated contracted cargo company, the return shipping cost is borne by the Seller.
7.4. The Seller shall refund all payments collected, including any delivery costs of the product to the Buyer, within a maximum of 14 (fourteen) days from the date the withdrawal notification reaches them, in a manner consistent with the payment method used by the Buyer during purchase, and without incurring any additional costs or obligations.
8. Cases Where the Right of Withdrawal Cannot Be Exercised
Pursuant to Article 15 of the Regulation; the right of withdrawal cannot be exercised for products prepared in line with the Buyer's requests or personal needs (including custom glass wall art produced with photos/visuals uploaded by the Buyer) (Art. 15/1-c). This matter is separately notified to the Buyer before placing a custom product order, and by confirming the order, the Buyer is deemed to have accepted this exception. In cases of defective performance for custom products, the Buyer's rights arising from the Law are reserved.
9. Defective Product
In the event that the delivered product is contrary to the agreement (defective), the Buyer may exercise one of the rights: return the product for a refund, a price reduction proportional to the defect, free repair, or replacement with a non-defective equivalent (Law Art. 11). Applications regarding these requests can be made to info@camtablolar.com. Products are covered by a 2 (two) year legal warranty from the delivery date for manufacturing and printing defects.
10. Protection of Personal Data
The personal data of the Buyer is processed in accordance with Law No. 6698 on the Protection of Personal Data, solely for the purpose of establishing and fulfilling the order and complying with legal obligations. 11. Force Majeure
In the event that one of the parties is unable to fulfill its obligations due to unforeseen circumstances not existing at the time of signing the agreement and beyond the control of the parties (such as natural disaster, epidemic, war, strike, general interruption in communication or transportation infrastructure, etc.), the unfulfilled obligations shall be suspended for the duration of the force majeure event. If the force majeure event lasts for more than 30 (thirty) days, either party may unilaterally terminate the agreement; in this case, the amount paid by the Buyer shall be refunded.
12. Dispute Resolution
In disputes arising from this agreement, the Consumer Arbitration Committees at the place where the Buyer purchased the product or where their residence is located, within the monetary limits announced annually by the Ministry of Trade, shall be authorized; for disputes exceeding these limits, the Consumer Courts shall be authorized. The Buyer may also submit their complaints and objections through the Ministry of Trade Consumer Information System (TÜBİS).
13. Effectiveness
The Buyer is deemed to have accepted all terms of this agreement when they complete the payment for their order placed through the Site. This agreement enters into force on the date the order is electronically confirmed, and a copy of the agreement is made available to the Buyer as an attachment to the order confirmation email/on their account page.
